By creating an account, posting a project, selecting an Artist, making a payment, or otherwise using the Platform, you (“Client”, “you”, or “your”) agree to these Terms.

If you do not agree to these Terms, you must not use the Platform.

1

PURPOSE OF THE PLATFORM

www.3d1.in (3d.one) is a digital platform that connects independent 3D Artists with architects, interior designers and other Clients.

The Platform may facilitate:

  • Project posting and submission;

  • Collection and processing of Client payments;
  • Deduction of Platform fees;

  • Project delivery and approval; and
  • Assistance with project-related disputes.

The Platform itself is not ordinarily the provider of architectural, interior-design, 3D modelling, rendering, or visualisation services.

Artists listed on the Platform operate as independent service providers.

2

  1. You are legally capable of entering into a binding agreement;

5

CLIENT'S RIGHTS TO UPLOADED MATERIALS

By uploading drawings, models, photographs, plans, references, logos, or other materials, you confirm that you have the necessary rights, permissions, licences, or authority to use and share those materials for the project.

You must not knowingly upload material that:

  • Infringes another person's intellectual-property rights;
  • Contains unlawful content;
  • Breaches confidentiality obligations; or
  • You are not authorised to share.

You remain responsible for claims arising from materials supplied by you.

6

SELECTION OF 3D ARTIST

The Platform may provide Artist portfolios, profiles, ratings, experience, availability, pricing, or other information to assist Clients in selecting an Artist.

The Client is responsible for reviewing the Artist's profile and determining whether the Artist is appropriate for the project.

The Platform does not guarantee that an Artist will meet a Client's particular creative expectations unless expressly agreed as part of a Platform service.

7

PROJECT AGREEMENT

Before work begins, the Client and Artist should establish the project requirements, including where applicable:

  • Scope of work;
  • Deliverables;
  • Number of renders/views;
  • Resolution;
  • Modelling requirements;
  • Animation requirements;
  • Deadline;
  • Number of revisions;
  • Project price;
  • Milestones; and
  • Other special requirements.

The agreed project scope may be recorded through the Platform.

Any work requested outside the agreed scope may be considered additional work and may require additional payment.

8

PLATFORM PAYMENT MODEL

The Platform operates as a payment-facilitation and marketplace service connecting independent Artists with Clients.

Unless otherwise specified for a particular project:

PAYMENT PROCESS The Client pays the project amount to the Platform.

From the applicable project amount, the Platform deducts its Platform Commission and applicable GST on that commission.

The remaining amount is payable to the Artist, subject to the applicable payment, approval, refund, cancellation, dispute, and payout conditions.

9

TAXES AND GST

Applicable taxes will be charged and handled in accordance with applicable law.

GST applicable to the Platform's commission/service fee may be charged to the Client as required.

The Client is responsible for providing accurate GSTIN or other tax information where applicable.

The Platform may issue invoices, receipts, or other tax documentation in accordance with applicable law.

The Artist may have separate tax obligations relating to amounts received by the Artist.

10

ARTIST PAYMENT

After deduction of the applicable Platform Commission, GST on the Commission, and any other lawful or disclosed deductions, the balance attributable to the Artist will be processed for payout in accordance with the Platform's payout policy.

Artist payouts may be subject to:

  • Project completion;
  • Client approval;
  • Milestone completion;
  • Refund or cancellation requests;
  • Dispute resolution;
  • Payment reversals;
  • Fraud or security checks; and
  • Other legitimate reasons permitted under the Platform's policies.

The Platform may delay a payout where reasonably necessary to investigate a suspected fraud, payment reversal, dispute, or violation of these Terms.

11

NO DIRECT PAYMENT TO ARTISTS

For projects initiated through the Platform, Clients must make payments through the Platform unless the Platform expressly authorises another payment method.

Clients must not intentionally pay an Artist directly for the purpose of avoiding the Platform Commission.

The Platform may suspend or terminate accounts that deliberately circumvent the Platform's payment system.

12

OFF-PLATFORM TRANSACTIONS AND CIRCUMVENTION

If a Client discovers or engages an Artist through the Platform, the Client must not intentionally move the project outside the Platform for the purpose of avoiding applicable Platform fees.

This includes:

  • Direct bank transfers;
  • Cash payments;
  • Direct payment applications;
  • Third-party payment links; or
  • Other arrangements designed to bypass the Platform.

Where the Platform reasonably determines that a Client has deliberately circumvented the Platform, it may suspend or terminate the Client's account and take other lawful measures available to it.

13

COMMUNICATION WITH ARTISTS

Clients may communicate with Artists through Platform-supported communication channels.

Clients agree to communicate professionally and respectfully.

Clients must not:

  • Harass or threaten Artists;
  • Request illegal work;
  • Discriminate against Artists;
  • Request infringement of third-party intellectual property;
  • Attempt to obtain unauthorised access to Artist accounts or systems; or
  • Misuse an Artist's personal information.
14

DEADLINES

The Artist should complete the project within the agreed deadline.

However, the deadline may be affected where the Client:

  • Delays providing drawings or information;
  • Provides incomplete information;
  • Changes project requirements;
  • Delays feedback;
  • Requests additional revisions;
  • Requests additional work; or
  • Makes substantial changes to the original project.

The Platform is not responsible for delays caused by the Client or circumstances outside the Platform's reasonable control.

15

REVISIONS

The number of revisions included in the project should be agreed before work begins.

A revision generally means a reasonable modification to the original agreed scope.

The following may be considered additional work:

  • New camera angles;
  • Additional views;
  • Completely different design directions;
  • Major modelling changes;
  • New architectural drawings;
  • Major material changes;
  • Additional animation;
  • Significant changes after approval; or
  • Work outside the original project scope.

Additional charges may apply.

16

CLIENT FEEDBACK

The Client agrees to provide clear and reasonably prompt feedback.

Where the Client delays feedback or approval, the project deadline may be extended accordingly.

The Client should consolidate feedback wherever reasonably possible to avoid unnecessary repeated revisions.

17

PROJECT APPROVAL

Where the Platform provides an approval mechanism, the Client's approval may constitute acceptance of the relevant deliverable.

Once a deliverable has been approved, subsequent changes may be treated as additional work.

Approval does not prevent the Client from raising a legitimate issue where the Artist has materially failed to deliver the agreed scope.

18

CANCELLATION BY CLIENT

A Client may request cancellation of a project.

However, A Client can not cancel a project in mid progress.

The Platform may determine an appropriate refund in accordance with its refund and dispute policies and applicable law.

19

REFUNDS

Refunds are subject to review and are not automatically guaranteed.

If a Client believes that an Artist has materially failed to deliver the agreed project, the Client should raise the issue with the Platform as soon as reasonably possible.

The Platform may review relevant evidence including:

  • Project requirements;
  • Messages;
  • Files;
  • Submitted work;
  • Revision requests;
  • Approval records;
  • Payment records; and
  • Other relevant information.

Where appropriate, the Platform may issue a full refund, partial refund, credit, or no refund, subject to applicable law.

20

DISPUTES BETWEEN CLIENT AND ARTIST

Clients should first attempt to resolve project issues directly with the Artist.

If the issue cannot be resolved, the Client may contact the Platform.

The Platform may facilitate communication and review available project information.

The Platform's role in a dispute is primarily that of a marketplace facilitator and dispute-support provider and does not make the Platform the employer of the Artist.

21

INTELLECTUAL PROPERTY

Unless otherwise agreed:

Client-owned material

The Client retains rights in drawings, plans, designs, photographs, models, branding, and other materials originally supplied by the Client.

Artist-owned material

The Artist retains rights in their pre-existing:

  • Scripts;
  • Tools;
  • Techniques;
  • Templates;
  • Generic assets;
  • Workflows;
  • Software setups;
  • Know-how; and
  • Other pre-existing intellectual property.

Final deliverables

Ownership or licensing of final project deliverables will depend on the project agreement and applicable law.

Unless otherwise agreed, payment for a project does not automatically transfer ownership of every underlying asset, model, texture, software file, or tool used by the Artist.

22

SOURCE / EDITABLE FILES

The Client is not automatically entitled to receive editable source files such as:

  • 3ds Max files;
  • Maya files;
  • Blender files;
  • Photoshop files;
  • CAD files;
  • Scene files;
  • Scripts;
  • Materials;
  • Textures; or
  • Other working files.

Source files will only be provided if they are specifically included in the agreed project scope.

Additional charges may apply.

23

THIRD-PARTY ASSETS

Projects may contain third-party assets such as furniture models, vegetation, vehicles, textures, HDRIs, fonts, stock images, plugins, or other licensed resources.

Such assets may remain subject to third-party licences.

The Client must not assume that payment for a rendering project grants ownership or redistribution rights over third-party assets.

24

CONFIDENTIALITY

Clients and Artists may exchange confidential project information.

Both parties are expected to keep non-public project information confidential and must not knowingly misuse or disclose confidential information.

If a Client requires a formal Non-Disclosure Agreement (“NDA”), the Client should arrange an appropriate NDA with the Artist before sharing highly confidential information.

The Platform may disclose information where required by law or reasonably necessary to operate the Platform, investigate fraud, resolve disputes, or protect users and the Platform.

25

PORTFOLIO AND MARKETING USE

The Artist may wish to display completed work in their portfolio, website, social media, or professional presentation.

Where a project is confidential or has not yet been publicly released, the Client may request that the Artist not publicly display the project.

The Platform may also request permission to use completed project work for marketing or promotional purposes.

Confidential projects should not be publicly displayed without appropriate permission.

26

ARTIST INDEPENDENCE

Artists are independent service providers.

Nothing in these Terms creates an employment, partnership, joint venture, agency, or employer-employee relationship between the Client and the Artist or between the Platform and the Artist.

The Artist is responsible for their own equipment, software, working methods, taxes, insurance, and professional obligations unless otherwise agreed.

27
